Welcome to New Wave Kiteboarding. By accessing our website, purchasing products, booking lessons, or reserving kiteboarding trips or charters, you agree to the following Terms of Service. Please read them carefully, as they outline important policies regarding payments, cancellations, refunds, risks, and the use of our services.


1. GENERAL CONDITIONS

New Wave Kiteboarding LLC (“New Wave,” “we,” “our,” “us”) operates www.newwavekiteboarding.com and provides online sales, kiteboarding instruction, clinics, guided experiences, and multi-day kiteboarding trips and yacht charters.

By using our website or purchasing any product or service, you represent that you are at least 18 years old and legally capable of entering into a binding agreement.

We reserve the right to refuse service to anyone for any reason at any time.

2. PRODUCT SALES (ONLINE RETAIL STORE)

2.1
We sell gear, equipment, accessories, and consumables. All orders are subject to availability and confirmation.


2.2 Returns & Refunds for Retail Products

Unless otherwise noted, the following conditions apply:

Eligible Returns

  • Most retail items may be returned within 30 days of delivery.

  • Items must be in new, unused condition with original packaging.

Non-Returnable Items

For safety, regulatory, and quality-control reasons, the following items cannot be returned or refunded:

  • Epoxy resin, hardeners, chemicals, catalysts

  • Opened or used consumables

  • Cut-to-length fabrics (fiberglass, carbon fiber, etc.)

  • Custom kits or mixed materials

  • Digital products

  • Gift cards

  • On-sale items
  • Pre-Owned Items

Return Shipping

Return shipping costs are the responsibility of the customer, unless the return is due to a shipping error on our part.

Refund Method

Refunds are issued to the original payment method once the returned item is inspected and approved.


3. LESSONS, CLINICS & DAY EXPERIENCES

When booking any lesson, clinic, or coaching session, you agree to the following policies:

3.1 Customer Cancellation

  • 72+ hours before lesson: Full refund or free reschedule.

  • 24–72 hours: 50% refund or one free reschedule.

  • Less than 24 hours or no-show: Payment is forfeited.

3.2 Weather & Safety Conditions

Kiteboarding is weather-dependent. If wind or conditions prevent a safe lesson:

  • We will reschedule your lesson or offer credit for a future booking.

  • Refunds are not automatically granted for weather cancellations but may be considered on a case-by-case basis.

3.3 Instructor Availability

We reserve the right to assign or reassign instructors as needed.
If New Wave must cancel for operational reasons, you will receive a full refund or reschedule.


4. MULTI-DAY TRIPS & CATAMARAN CHARTERS

This section applies to all kiteboarding travel experiences, including those operated in partnership with fleet operators such as Cruise Abaco.

These terms override all general cancellation rules above.

4.1 Deposit Handling

When you book a charter with New Wave Kiteboarding:

  • Your deposit is immediately transferred to the third-party vessel operator to secure your week.

  • Because the operator—such as Cruise Abaco—receives and holds the deposit, all refunds are governed by their policies, not solely by New Wave.

You acknowledge that New Wave acts as a booking and coordination partner, not the vessel provider.


4.2 Customer Cancellation (Charters & Travel)

Before the operator’s final payment deadline

  • Deposits may be refundable only if the operator authorizes the release.

  • Many operators require the week to be successfully rebooked before releasing any deposit funds.

  • If rebooking is required by the operator, the customer agrees to this condition at the time of booking.

After the operator’s final payment deadline (typically 90 days before departure)

  • Deposits and payments may become non-refundable according to operator rules.

  • If the operator cannot resell the week, no refund may be available.

Cancellation Fee

If New Wave processes a cancellation on your behalf, a $350 cancellation fee (plus applicable tax) will apply once a charter booking has been confirmed with the fleet operator.


4.3 Cancellation by New Wave or the Operator

If New Wave Kiteboarding or the vessel operator must cancel your trip for operational or safety reasons unrelated to guest cancellation, you will receive:

  • A full refund of all amounts paid, OR

  • The option to transfer credit to a future date (if preferred).

Force majeure conditions (weather events, border closures, pandemics, etc.) may be excluded and handled per operator policy.


4.4 Trip Insurance

We strongly recommend purchasing travel insurance.
New Wave is partnered with Allianz Travel Insurance, and trip insurance may cover:

  • Medical cancellations

  • Injuries preventing travel

  • Delayed or canceled flights

  • Trip interruption or delay

Purchasing insurance is the responsibility of the traveler unless explicitly added to your invoice.


4.5 Chargebacks

By booking a trip or charter with New Wave Kiteboarding, you agree that:

  • New Wave transfers deposits to the operator as part of delivering the booking service.

  • Refund timing and eligibility are determined by the operator’s policies.

  • Delays in refund release caused by the operator do not constitute refusal or nondelivery of services by New Wave.

  • Initiating a chargeback does not override agreed-upon cancellation terms.

We retain the right to dispute any chargeback that conflicts with published terms.


5. PAYMENT TERMS

We accept all major credit cards and other methods displayed at checkout.

Prices are listed in U.S. dollars unless stated otherwise.

Taxes, processing fees, and currency conversion may apply where relevant.


6. THIRD-PARTY SERVICES

6.1
Certain products, trips, or services involve third-party operators (e.g., Cruise Abaco, rental companies, charter fleets). By booking with New Wave, you acknowledge that:

  • Third-party terms apply in addition to ours.

  • Third-party providers may control refund timing and eligibility.

  • New Wave is not responsible for third-party operational decisions.


7. LIMITATION OF LIABILITY

Kiteboarding and related water sports carry inherent risks. By participating, you voluntarily assume all risks associated with:

  • Physical injury

  • Equipment damage

  • Weather or environmental hazards

  • Ocean conditions

  • Travel delays or disruptions

To the fullest extent permitted by law:

  • New Wave Kiteboarding is not liable for injuries, losses, damages, delays, or expenses resulting from participation in lessons, clinics, or travel experiences.

  • Our liability is limited to the amount you paid directly to New Wave for the affected service.

You may be required to sign a waiver prior to participating in lessons, clinics, or charters.


8. INTELLECTUAL PROPERTY

All website content, photos, videos, logos, descriptions, and branding belong to New Wave Kiteboarding LLC and may not be copied or reproduced without permission.


9. PRIVACY

Your personal information is handled according to our Privacy Policy.


10. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
